Are hashtag campaigns and UGC a music copyright risk for brands?

A hashtag campaign and the UGC it generates can absolutely be a music copyright risk, and the risk turns on one action: adoption. A fan posting your product to their own followers is their use of the music. The moment your brand reposts, stitches, embeds on a landing page, or runs that clip as an ad, your brand is now using the song commercially. The content did not change. Your relationship to the music did.

The reframe: there is a bright line between content people made and content the brand adopted, and brands cross it without noticing because a repost feels like sharing rather than publishing. Legally it is publishing.

The two risks a campaign creates

Volume. A successful hashtag campaign is thousands of posts you did not script, each free to use whatever audio the creator liked. Most brands never inventory this. It is celebrated while it trends and forgotten afterward, which is precisely when a rights holder might come looking.

Adoption. The pieces you love and amplify are the ones that pull the brand from bystander to user. The better the UGC, the more likely you are to repost it, and the more likely you are to inherit its music risk.
